Real Estate

Leases, purchases, and co-ownership arrangements tie up large sums for years, and the documents behind them decide who bears the risk. The Schenk Law Firm advises businesses, investors, families, landlords, and tenants on commercial leases, property transactions, and real estate disputes.

Our Real Estate Practice

Commercial Leases

We draft, review, and negotiate leases for landlords and tenants. That work covers letters of intent, amendments, rent relief, subleases, assignments when a business is sold, and lease exits.

Real Estate Transactions

We represent buyers, sellers, investors, and co-owners. That work covers purchase agreements, escrow problems, 1031 exchanges, tenancy-in-common agreements, property-holding LLCs, options, easements, real estate offerings, and construction contracts.

Medical & Healthcare Real Estate

Leases, renewals, buildouts, and building purchases for physicians, dentists, therapists, med spas, and the owners who lease space to them.

Real Estate Disputes

We resolve disputes through demand letters, negotiation, and mediation. That work covers seller nondisclosure claims, commercial landlord-tenant disputes, co-owner disputes over sale proceeds, and easement disputes.

Common Client Concerns

Where should I start if I’m not sure what kind of help I need?

Use the form on this page to describe the property, the documents involved, and any deadline you’re facing. We’ll tell you which part of our practice fits and what we’d need to review.

Do you handle residential property?

Yes, for purchases, sales, co-ownership agreements, and disputes over residential property. We don’t file eviction (unlawful detainer) cases.

Can you help with property outside California?

Our attorneys are licensed in California. For a lease in another state, we can review the business terms and work with local counsel on the provisions that depend on that state’s law.

FAQs

How is a real estate attorney different from my agent or broker?

An agent or broker negotiates price and business terms and can’t give legal advice. We advise on the legal terms of the documents and your rights under them, and we work alongside your agent or broker.

Do you represent landlords or tenants?

Both. We draft leases for landlords and negotiate leases for tenants.

Can you help with a 1031 exchange?

Yes. We act as counsel to the owner making the exchange and work with the qualified intermediary and the owner’s tax advisor. We don’t act as the intermediary.

What documents help at a first consultation?

The lease, purchase agreement, or co-ownership agreement at issue, any amendments, and any notices from the other side. If a deadline is coming up, tell us the date.
