Your Guide to Insurance Claims and Disputes in California

Insurance is meant to provide peace of mind. You pay your premiums so that when life takes a wrong turn—through a car crash, storm, injury, or theft—you’ll have a financial safety net. Unfortunately, that’s not always how things work in practice.

At The Schenk Law Firm, we help individuals and families across California hold insurance companies accountable. Whether you’re dealing with a denied claim, a lowball settlement, or complex uninsured motorist issues, we’ll stand by your side and fight for what you’re owed.

Understanding the Role of Insurance

Insurance is a contract. In exchange for your premium payments, the insurance company promises to protect you against specific financial losses—from medical costs and property damage to lost income and more. There are many types of insurance, including:
Auto Insurance

  • Homeowners & Renters Insurance
  • Business Insurance
  • Life and Health Insurance
  • Uninsured/Underinsured Motorist (UM/UIM) Coverage

But what happens when the insurance company doesn’t hold up their end of the bargain?

Insurance Bad Faith: When Insurers Break Their Promise

California law requires insurance companies to treat policyholders fairly. When an insurer unreasonably delays or denies payment of a valid claim, or otherwise acts in bad faith, you have the right to take legal action.

Examples of insurance bad faith include:

  • Denying a claim without a valid reason
  • Failing to investigate a claim promptly
  • Offering far less than a claim is worth
  • Misrepresenting policy terms or coverage
  • Delaying payment to pressure a settlement

At The Schenk Law Firm, we represent clients in both first-party bad faith claims (when your own insurer mistreats you) and third-party bad faith (failure to settle within policy limits, exposing you to excess liability). Our experienced trial team will not hesitate to sue insurance companies to enforce your rights and recover punitive damages when appropriate.

Uninsured and Underinsured Motorist (UM/UIM) Coverage

Did you know that 1 in 6 drivers in California has no auto insurance? And many more carry only the state’s minimum coverage—which may be far too little to cover serious injuries. That’s why UM/UIM coverage is one of the most important parts of your auto policy.

What UM/UIM Coverage Does:

  • Uninsured Motorist (UM): Covers your damages when the at-fault driver has no insurance.
  • Underinsured Motorist (UIM): Covers the gap when the at-fault driver’s insurance is not enough to pay your total losses.

UM/UIM can also protect you in hit-and-run cases and is often surprisingly affordable to add or increase on your policy.

Recent Legal Developments:

  • In 2025, California’s minimum liability coverage will rise to $30,000 per person / $60,000 per accident / $15,000 property damage (SB 1107).
  • Even with this increase, serious accidents can easily exceed these limits—making robust UM/UIM coverage critical.

Our firm not only educates clients on the smart way to match liability and UM/UIM coverage, but we also help them fight insurers who delay or deny legitimate UM/UIM claims.
